Please read this entire agreement so you know and understand the program rules.
1. BG5 Business Institute Affiliate Agreement
This agreement describes the terms and conditions for participation in the BG5 Business Institute Affiliate Program. In this agreement, the term “Affiliate” refers to you (the applicant). In this agreement, BG5 Business Institute refers to the product owner and publisher, (BG5 Business Institute).
2. Modification
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available referral fees, fee schedules, payment procedures and Affiliate Program rules. If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUE PARTICIPATION IN THE PROGRAM, it will be considered as your acceptance of the change.
3. Enrollment
To enroll in the program and get paid as an affiliate you must complete the following...
1. Read and understand this agreement and click the I ACCEPT button below.
2. Enter your PayPal email address for the commission payment under Affiliate Sales Report Tab under My Account. Note: Payments are made through PayPal ONLY. Payments can not be released without a PayPal email address.
3. If you are U.S. Citizen you must also upload a complete W-9. You can download the W-9 form here > Download W-9. You can upload the completed W-9 form here > Upload W-9. Payments for US Citizens will not be released without a completed W-9 on file.
4. Affiliate Log-In and Unique URLs
Once you are accepted into the program you be able to access your BG5 Business Institute Affiliate information under your profile in your BG5BI user account. This area will contain all of your personalized URLs and codes that you can used to promote specific BG5 Products and Courses.
5. Affiliate Commissions
Affiliates will receive commissions for specific products and courses from orders placed through properly coded Affiliate links. Commissions may change at the discretion of the product publisher, BG5 Business Institute. Coupons cannot be used in conjunction with the affiliate program – there are no double discounts and you will not receive commission if a coupon is used to purchase the product.
For a sale to generate a commission to an Affiliate, a customer must complete the order form and remit full payment for the product ordered through the secure order system. Word of mouth referrals will not result in an affiliate commission being generated. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly placed and coded links are the sole responsibility of the affiliate.
If a customer purchases a Package, the affiliate will be paid separately for each qualifying item in the package ONLY AFTER the client has received the item or taken the course. For example, if a client purchases a BG5 Foundation Course Package – the affiliate will receive commission for Semester 1 after the customer has started Semester 1. The affiliate will receive commission for Semester 2 after the customer has started Semester 2, etc.
If a customer is on a Payment Plan, the affiliate will not receive a commission until the course or product has been paid for in full.
6. Payment
BG5 Business Institute pays affiliates quarterly via PayPal ONLY. You must provide a PayPal email address to be accepted into the Affiliate Program and to receive your commission. Please be aware that PayPal fees will apply. The Affiliate Program will not go into effect without a W-9 if you are a U.S. citizen. You will be paid Quarterly via PayPay on or before the last day of the following months:
January - For commissions earned in October, November and December
April - For commissions earned in January, February and March
July - For commissions earned in April, May and June
October - For commissions earned in July, August and September
Commissions will be released when the commission amount reaches $50 or more. Any commission earned below $50 will be rolled over to the next quarterly payment until it reaches $50 or more.
7. Order Fulfillment
BG5 Business Institute will be solely responsible for processing every order placed by a customer via affiliate links. All affiliates understand and acknowledge that no physical products will be shipped. All rules, policies, and operating procedures concerning customer orders and service will apply to the customers placing their order on the BG5 Business Institute website. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. BG5 Business Institute policies will always determine the price paid by the customer.
8. Qualifying Sites
BG5 Business Institute reserves the right to refuse any site entry into the BG5 Business Institute Affiliate Program based on site content. Sites that do not qualify for the Affiliate Program include sites which:
-Promote sexually explicit materials
-Political sites endorsing one party or candidate
-Promote violence
-Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
-Promote illegal activities
-List coupon codes or discounts that were NOT officially provided to them by BG5 Business Institute
9. Permitted Usage
The following are permitted uses of the BG5 Business Institute brand and marketing resources:
Affiliates are permitted to use approved BG5 Business Institute graphics and logos provided to the Affiliate by the BG5 Business Institute through the BG5 Affiliate Center. Graphics and logos provided to Affiliates must be used exactly as provided with no alterations.
10. Prohibited Usage
The following cases are prohibited and are grounds for immediate termination of the affiliate account.
-Affiliates MAY NOT use the BG5 Business Institute logo, logo marks or other BG5 Business Institute website/branding imagery in a header graphic or in any way as to indicate they are officially affiliated or partnered with BG5 Business Institute/BG5 Business Institute.
-Affiliates MAY NOT use the term “BG5 Business Institute” in ANY variation in their site URL.
-Affiliates MAY NOT promote links that were not provided to them personally by BG5 Business Institute
-Affiliates MAY NOT host or promote “coupon stacking” sites where customers may combine coupons to receive additional discounts.
-The content of the BG5 Career Design Overview or Analysis Reports is copyright protected and MAY NOT be copied, reproduced or translated in any form.
11. BG5 Business Institute Anti-Spam Policy
BG5 Business Institute strictly prohibits affiliates from using spam e-mail and other forms of Internet abuse (including spamming forums, blogs, Twitter, Facebook and other social media outlets) to seek sales.
12. Relationship of Parties
Affiliates are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. Affiliates have no authority to make or accept any offers or representations on our behalf. Affiliates will not make any statement, whether on their sites or otherwise, that reasonably would contradict this statement.
13. Term and Termination
The term of this Agreement will begin when you accept and will end when terminated by either party. Either BG5 Business Institute or the affiliate may terminate this Agreement at any time, with or without cause.
14. Limitation of Liability
BG5 Business Institute will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to the affiliate under to this Agreement. The BG5 BI has no financial liability of any kind in regards to claims or issues of any kind raised by clients of the Affiliate about services or goods provided by the Affiliate.
15. Disclaimers
We make no express or implied warranties or representations with respect to the Affiliate Program or an affiliate’s potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of the websites or the Affiliate links will be uninterrupted or error free, and BG5 Business Institute will not be liable for the consequences of any interruptions or errors.
16. Miscellaneous
Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.
By signing up with the BG5 Business Institute Affiliate Program, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
